§ 1 Scope and provider
(1) These general terms and conditions ("Terms") apply to all contractual relationships between:

(hereinafter "NextChapter" or "we") and the client ("you").
(2) NextChapter provides immigration consulting and support services to individuals planning to study, train, work, or settle in Germany and other destination countries.
(3) Deviating, conflicting, or supplementary terms of the client shall not become part of the contract unless we expressly agree to their validity in writing.
§ 2 Description of services
(1) NextChapter offers the following services:
- Assessment call (€10): An AI-assisted pathway assessment and a short consulting call to identify the best visa pathway for your situation.
- Visa support package: Document preparation and review, appointment assistance, mock interview preparation, and application checklists.
- Arrival support package: Assistance with airport pickup coordination, address registration (Anmeldung), bank account setup, health insurance, and housing.
- On-site support package: Ongoing support with integration, visa renewals, work matters, and settlement.
(2) The exact scope of each package is defined on our website at the time of booking. We reserve the right to further develop and improve our services while preserving their essential scope.
(3) Our services are delivered via a combination of our online portal, video or phone calls, email, and — where agreed — in-person meetings.
(4) To access our portal you need a current web browser and an internet connection. These are not part of our service.
§ 3 Contract formation and registration
(1) The presentation of our services on the website does not constitute a legally binding offer, but an invitation to submit an offer.
(2) By registering on our platform and booking a service, you submit a binding offer to enter into a service contract.
(3) The contract comes into effect upon our written confirmation (in text form, e.g. email) or upon our start of service performance, whichever is earlier.
(4) You are obliged to provide truthful information and to protect your access credentials (email and password) from third-party access.
§ 4 Services and prices
(1) All prices shown are final prices. NextChapter operates as a small business under § 19 UStG (Kleinunternehmerregelung) and therefore does not charge VAT.
(2) Current prices for all services are displayed on our website at the time of booking.
(3) We reserve the right to change our prices with 30 days' notice. Services you have already booked and paid for remain unaffected by price changes.
§ 5 Payment
(1) Payment is processed through our payment service provider Stripe. The terms of use of Stripe apply.
(2) The following payment methods are available:
- Credit card (Visa, Mastercard, American Express)
- Klarna (where supported)
(3) Payment is due immediately upon booking. After successful payment, the booked service is activated.
(4) If a payment fails, we reserve the right to restrict access to the service until payment has been received.
§ 6 Right of withdrawal for consumers
Withdrawal instructions
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day of contract conclusion.
To exercise your right of withdrawal, you must inform us (NextChapter, Maureen Njeri-Duennebacke, New York Str. 22, 35510 Butzbach, Germany, maureen@next-chapter.net) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email).
To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal
If you withdraw from this contract, we will refund all payments received from you promptly and no later than 14 days from the day on which we receive notification of your withdrawal.
Early performance and loss of right of withdrawal
If you expressly request that we start the service before the end of the withdrawal period, you agree to pay a proportionate amount for services already rendered if you withdraw. The right of withdrawal expires if the service has been fully performed, provided that performance began with your express prior consent and your acknowledgement that you lose your right of withdrawal upon full performance.
§ 7 Client obligations
(1) You agree to:
- use the service only for lawful purposes;
- provide accurate, complete, and truthful information in your profile and documents;
- upload only documents for which you hold the necessary rights;
- keep your access credentials confidential and protect them from unauthorised access;
- notify us without delay of any unauthorised use of your account;
- not use automated access or bots without our express consent;
- not take any action that could impair the functionality of our service.
(2) You are responsible for all activity conducted under your account.
(3) You acknowledge that incomplete or inaccurate information may delay or prevent successful outcomes of visa or immigration procedures.
§ 8 Scope of advice and disclaimer
(1) NextChapter is an immigration consulting service. We provide information, document preparation support, and guidance based on publicly available rules and our experience.
(2) NextChapter does not provide legal advice within the meaning of the German Legal Services Act (Rechtsdienstleistungsgesetz — RDG). Where a matter requires legal representation, we will refer you to an appropriate lawyer (Rechtsanwalt).
(3) Visa, residence, and immigration decisions rest solely with the competent authorities (embassies, consulates, and immigration offices) of the respective destination country. We cannot guarantee any specific outcome.
(4) AI-assisted assessments and recommendations on our platform are informational only and do not constitute a binding statement on the likelihood of a successful application. You are responsible for reviewing and verifying all information before relying on it.
§ 9 Privacy and confidentiality
(1) The processing of personal data takes place in accordance with our privacy policy.
(2) We treat all data and documents transmitted by you confidentially and use them exclusively for the provision of our service.
(3) Where required for the processing of personal data on your behalf (e.g. for clients who are themselves businesses), we conclude a data processing agreement in accordance with Art. 28 GDPR. You can view our standard DPA at Data Processing Agreement.
§ 10 Intellectual property
(1) All rights to the software, the service, the underlying algorithms, checklists, templates, and documentation remain with us. You receive only a simple, non-transferable, non-sublicensable right of use for the duration of the contractual relationship.
(2) You retain all rights to documents you upload and the data they contain.
(3) We are entitled to use aggregated and anonymised usage data to improve our service.
§ 11 Availability and support
(1) We strive for high availability of our portal but do not guarantee uninterrupted availability. In particular, we do not accept liability for interruptions due to:
- scheduled maintenance (announced in advance where possible);
- disruptions outside our control (force majeure, internet provider outages, etc.);
- security measures required to protect the integrity of the service.
(2) Support is offered by email to maureen@next-chapter.net during usual business hours (Mon–Fri, 9:00–17:00 CET).
§ 12 Liability
(1) We are liable without limitation for damages arising from injury to life, body, or health, as well as for damages based on intent or gross negligence.
(2) In the case of ordinary negligence, we are only liable for breach of material contractual obligations ("cardinal duties"). In such cases, liability is limited to foreseeable damages typical for the contract.
(3) The above limitations of liability do not apply to claims under the Product Liability Act or where a guarantee has been assumed.
(4) We are not liable for:
- the accuracy of AI-generated assessments — these are suggestions and must be reviewed by you;
- damage caused by incorrect input or unsuitable documents provided by the client;
- loss of profit or indirect damages;
- decisions by visa or immigration authorities.
§ 13 Term and termination
(1) The portal account is open-ended and can be terminated at any time.
(2) You can close your account at any time without giving reasons via your account settings or by emailing maureen@next-chapter.net.
(3) We may terminate the portal account with 30 days' notice to the end of a month.
(4) The right to extraordinary termination for cause remains unaffected. Cause includes, in particular, a material breach of these Terms by the client that is not remedied within 14 days of a warning, or use of the service for unlawful purposes.
(5) Already-started service packages will be completed and billed in accordance with the booking confirmation.
§ 14 Changes to these terms
(1) We reserve the right to change these Terms with effect for the future if this is necessary due to changes in law, case law, technical developments, or changes to our business model, and if you are not unreasonably disadvantaged.
(2) Changes will be communicated to you at least 30 days before they take effect. If you do not object within this period, the amended Terms are deemed accepted.
(3) In the event of an objection, both parties have an extraordinary right of termination at the time the changes take effect.
§ 15 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the client has their habitual residence remain unaffected.
(2) Place of performance and, where permitted, exclusive place of jurisdiction for all disputes arising from this contractual relationship is the registered office of NextChapter.
(3) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
